Booking Conditions

Maenporth is an exclusive holiday destination for wonderfully relaxing, family-friendly holidays in a natural and peaceful environment.  We want you and all our guests to have an amazing time with us and, like all UK holiday rental property owners, we are legally obliged to meet a number of insurance and health & safety requirements while you are on site. Our booking conditions are therefore designed with your wellbeing and enjoyment in mind to meet these legal requirements and to make everyone’s stay a great – and stress-free – one.

Please read the booking conditions below and Code of Conduct carefully before booking your Maenporth holiday to check that you are happy to follow our ‘house rules’ while staying with us. These can be found on our website. Maenporth Coastal Holidays Ltd (MCHL) acts as an Agent for the Owner of the Property (Owner).  The letting contract is between the Owner and the Guest.  The Guest is the person who completed the booking form and is solely responsible for all the obligations under this contract.  No tenancy agreement is entered into or is implied by this contract.

Booking: To make a booking you must be over 18 years of age on the date of the booking and have legal capacity and authority to book the holiday under the given lead name.  Small family groups and friends are welcome but not party groups such as hen or stag parties, sporting events or school groups.  Multi property bookings will be limited to a maximum of 3 properties per family group to reduce the size of large groups visiting the Estate.  We reserve the right to cancel group bookings.  The Owner and MCHL on behalf of the owner reserve the right to cancel this contract immediately if tenants other than those listed on the booking form are occupying the Property or if tenants cause a nuisance to the neighbours or damage to the Property.  In such a circumstance, neither the Agent or the Owner accept any liability for expenses, costs, losses or claims for any sum of money incurred, as a consequence of cancellation of this contract.

Please note that 
i.       Pets are not permitted on any part of the Property,
ii.      Smoking is not permitted inside the Property, in communal areas, on balconies and patios.

iii. Use of candles is not permitted inside the Property.

iiii. Any electrical items brought by the Guest must be in a safe, good working condition with the relevant safety standards to be used within the Property such as the kite mark. This applies to items such as laptops, chargers, hairdryers and coffee machines.

Payment: 25% deposit is required at the time of booking. Only after receipt of the deposit will the booking be confirmed by email.  If, for any reason, the booking cannot be confirmed your deposit will be returned to you under the Owner’s discretion after the request has been given to us in writing to state the reasoning the booking cannot take place. Once a booking is confirmed, the Guest is liable for the full rent and the balance owing must be paid in no less than 6 weeks before the arrival date. If the balance is not received by the confirmed due date, MCHL reserves the right to make the property available again for rebooking. This does not release the guest from their obligation.  If a booking is made less than 6 weeks days before the arrival date, then the full rent must be paid at the time of booking. 

Provisional bookings can only be held for up to 24 hours. If your booking has not been confirmed by the Guest within this time, the Agent may offer the dates to another Guest. (Please note that emails or voicemail messages left outside of working hours will not be accepted as confirmation until the next working day. Your booking is not confirmed until the Agent has replied to your message).

A security deposit of £150.00 is payable.  This will be refunded within 14 days of the completion of your holiday provided there are no breakages/damage, and the Guest has adhered to this contract and the Maenporth Code of Conduct. The Agent can also deduct any costs for damage to other parts of the Estate such as the Leisure Centre from the security deposit.  

The Owner reserves the right to retain part or all the security deposit for any reason should they deem it necessary. Whilst every effort will be made to resolve any disputes. MCHL cannot act as a mediator in any dispute between the Owner and Guest over the security deposit. Such disputes shall be settled between MCHL and the Owner for whose actions MCHL cannot accept responsibility for. Any reasoning for retainment will be provided to the Guest in writing by MCHL from the Owner.


Cancellation: Cancellation of a booking must be made in writing to MCHL, with refunds being made on the following basis:

We therefore strongly advise you to take out holiday insurance to cover possible cancellation costs. We cannot advise on holiday insurance available. Therefore, we do not take responsibility for lost or stolen items within the grounds of Maenporth Estate. We suggest the policy you take out covers this.

MCHL have the right to cancel a booking on behalf of the owner if the property becomes unavailable due to external factors such as through fire or flooding. In the unlikely event this occurs, a full refund will be made of all monies paid towards the holiday. MCHL or the Owner do not accept liability should this occur.

The 25% deposit will only be refunded on the terms set out below:

  1. If Government legislation and/or official guidance prevents your use of the Property.
  2. Deposits will not be refunded for periods of time when these restrictions do not apply.
  3. If a Property becomes unavailable for the reasons given in point (a) above and the 25% deposit is refunded, the Guest will have no further claims on the Owner or MCHL.

Booking Postponement: The 25% deposit paid is non-refundable as per the above cancellation policy. Should you need to cancel your holiday due to exceptional circumstances, we can liaise with the Owner of the Property to determine if they would be willing to postpone your stay to a different date. The new date would have to be within the same year as the original booking was due to take place. The retained deposit can then be transferred across. The Property Owner is under no obligation to allow this, and so is fully at the Owner’s discretion as the deposit is non-refundable. If there is a cost difference in the price of the weeks, this will need paying as advertised at the new rate. Bookings cannot be postponed to the following year. If the Owner does not agree to this, the deposit will be retained as above, and the stay cancelled as per the request.

Property: The Guests’ party may enter the Property at any time after 4:30pm on the day of arrival and must vacate the Property by 10am on the departure day.  Guests are requested to advise Reception of their likely time of arrival and need to sign in at Reception on arrival. If Reception is closed, please register online using our new online Check-In form found at www.maenporthestate.com

Information on how to find Maenporth Estate and access to the Property will be sent to you 2 weeks prior to your arrival, (or at the time of booking for late reservations.) Guests are requested to leave the Property in a tidy condition. The Guest who made the booking is liable for any excessive cleaning required (highlighted by our housekeeping team,) and any damage to the Property. Guest Information Pack will be provided to you 2 weeks prior to your arrival in an email. 

All our properties are non-smoking/vaping and may result in a charge if ignored.

Number of People Using Accommodation: The Agent permits the Guests and members of the party (but no one else) to occupy the Property for holiday purposes only. The number of guests occupying the Property must be declared at the time of booking. If this changes or an error has occurred in your original booking details, you must inform the Agent at least 48 hours before the rental commences. It is the responsibility of the Guest to read all the booking information that is provided to them by the Agent and ensure it is correct. No more than the maximum number of persons stated on the booking form may occupy a Property unless by prior written agreement with the Agent. Extra charges may be applicable if the number of Guests differs from the original booking.

Car Parking Car parking is available for one car per property is in the designated parking areas provided for each group of properties – additional parking is available at the Leisure Centre in a visitor’s bay, or as arranged with the estate staff. Please be aware that you are parking at your own risk on site and that the estate accepts no responsibility for damage or theft. Two bicycle racks (own risk) are provided – at the Leisure Centre and by Lower Stables. Bicycles must not be left in communal hallways, leaning against property walls or causing obstruction. Special arrangements must be made in advance, via the Estate office, for parking/storage of dinghies and trailers (subject to availability). No caravans, commercial vehicles or mobile homes of any description are allowed to park on the Estate. Parking can be provided for larger vehicles, trailers and boats in the Boat Park on site at a cost of £35.00 for the duration of your stay.

Arrival/Departure: The Property is available for guests from 4:30pm on the first day of the holiday and must be vacated by 10am on the last day. Late departure may incur a charge which will be retained from your security deposit.

Damage/Loss/Theft: The Guest agrees to inform the Agent of any damage or loss however caused. The Guest should not remove anything from the Property. The Agent reserves the right to retain part or all of the security deposit to cover any costs arising on behalf of the Owner requesting.

All equipment in the Property should be in good working order.  If it is not or any fault occurs, it must be reported to Reception as soon as possible.  The Owner, any representative of MCHL or any professional tradesperson (on behalf of the Owner or MCHL) reserve the right to enter the Property at any reasonable time to correct any fault. MCHL will endeavour to inform the Guest of the need to enter the property and will try to gain consent should the Guest not be at the property at the expected time of visit. In an emergency, the Owner or any representative of MCHL may enter the Property without notice.

Maenporth Estate or Maenporth Coastal Holidays cannot accept responsibility for lost or stolen items within the Leisure Centre or within the grounds of the site, including communal areas, and inside individual properties. 

Returning Items: In some instances, lost property can be found once the Guest has departed. Should the Guest have left an item in the property, they will be contacted via telephone or email to arrange for the item to be posted back as agreed by the guest at a cost. If we still have the belongings 14 days after departure, they will unfortunately be discarded.

Property Amenities: MCHL or the Property Owner cannot be held responsible for any third-party breakdowns or cuts to utility services such as electricity, gas, water, mobile reception, Wi-Fi or broadband. Every attempt will be made by staff to help resolve or ease a problem as soon as possible should it occur.

Whilst MCHL and the Owner do expect these services to be fully operable for the Guest’s stay, disruptions can be common in rural areas where Maenporth is situated. No refund or relocation will be considered for the interruption of telecommunication issues.

Additional items such as a cot, or highchair could be available for the Property you are staying in. If these are available, they will be listed on the website. Please enquire before booking if these items are required for your stay. Please note, bed linen will not be provided for the cot, neither will a mattress.

If a stairgate is provided in the Property, please ensure the stairgate is installed using the wall fixtures you will find on either side of the wall to ensure it is securely fitted. These items are used at your own risk.

Electric Vehicles: The Guest is permitted to bring an electric vehicle however is strictly forbidden from charging the vehicle from the property which they are renting. If a vehicle is charged from the property, then the guest will be liable for any damages to the property as the internal fuse boxes are not designed to be used for this purpose and loose cables could cause a trip hazard. MCHL reserve the right to retain the full security deposit should this occur.

We have designated EV charge points situated by the Leisure Centre. These require the EV Charge Online App to operate. There are 4 chargers in total – two of which are 7kW and two points are 22kW, all with type 2 chargers. If you require any further information, please do contact Reception. Please note, vehicles that are not actively charging cannot be parked in these bays.  

Cleaning: The Guest is responsible for leaving the accommodation in good order and in clean condition. We allow certain amount of time to clean the Property following your departure. Properties left in a poor state will incur additional charges which will be deducted from the security deposit. Smoking in or near the Property will result in an extra charge. Should the Guest require additional linen or towels on top of the full sets provided, a cost will be incurred and shall be retained from the breakage/security deposit.

Charges will also be incurred should parties book more than one Property and move inventory items such as crockery and soft furnishings between the Properties when staying. Such items should not be removed from the Property they belong to. The charge will relate to the time taken to sort through the inventory items of the Properties in question.  
 
Liability: MCHL will not be liable for any act, neglect, or default on the part of the Owner or any other person not within the employment of or otherwise under their control, nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or Property, which the Guest or any other person may suffer or incur arising out of, or in any way connected with the letting contract. In addition, the Owner and MCHL accept no liability for loss of or damage to the Guest’s possessions on the Property.  Nothing in these conditions excludes or limits the liability of the Owner for:
 
i.       death or personal injury caused by the Owners negligence;
ii.      or any matter which it would be illegal for MCHL or the Owners to exclude or attempt to exclude their liability.
MCHL cannot accept any liability for any acts or omissions of the Owner or anyone representing, or employed by, the Owner. Neither does MCHL accept any liability for any shortcomings or defects with or in the Property.

The Owner and MCHL reserve the right to decline any booking (and future bookings) or refuse to hand over a key to any person who has not complied with these booking conditions. Any previous groups who have failed to comply with the Estate’s policies in the past are at risk of any future bookings being cancelled or declined on behalf of MCHL. MCHL reserve the rights to do this.

Photography and Property Information: All photography and property descriptions are the property of MCHL and cannot be used by any other party or purpose without prior written consent given by MCHL.

Descriptions and details both written and verbal are given in good faith and believed to be correct. MCHL reserve the right to amend property details and prices quoted on the website (www.maenporthestate.com) due to error or omission.

Maenporth Estate Code of Conduct: Please refer back to our Estate policy at www.maenporthestate.com for more information regarding our rules for the use of the leisure facilities and groundsFor individual safety and security, the Estate Code must be adhered to at all times. In particular, please keep noise to a minimum at all times but especially between 11pm and 8am. Maenporth does not tolerate anti-social behaviour. This includes drinking in communal areas, meeting up in large groups, playing loud music, shouting, swearing, littering, or otherwise breaching the Maenporth Estate Code of Conduct. Guests will be asked to leave and will not be allowed to return. MCHL reserves the right to retain damage deposits and your booking with Maenporth Estate will be cancelled with no right to a refund.

The staff at Maenporth are here to welcome you and help you enjoy your stay. Verbal abuse or physical threats or intimidation will result in you and your party being asked to leave immediately.

These booking conditions supersede any previous versions. MCHL reserve the right to amend these terms and conditions at any given notice.
